This Privacy Policy explains how Embassy Data Logistics, doing business as LaborAI ("LaborAI," "we," "us," or "our"), collects, uses, discloses, and protects personal information when you visit https://getlaborai.com/, communicate with us, request a demonstration, or use our software, applications, integrations, and related services (collectively, the "Services").

This Privacy Policy applies to information LaborAI handles as a business or data controller. When LaborAI processes personal information contained in customer-provided operational data on a customer's behalf, LaborAI generally acts as a service provider or data processor, and that processing is governed by the applicable customer agreement and data processing addendum.

1. Personal Information We Collect

Depending on how you interact with LaborAI, we may collect the following categories of information.

Information you provide

  • Contact and business information, such as your name, business email address, telephone number, job title, employer, warehouse locations, and industry.
  • Account information, such as login credentials, account identifiers, permissions, and preferences.
  • Sales and communications information, including demo requests, correspondence, meeting information, survey responses, support requests, and other information you provide to us.
  • Commercial information, such as services considered or purchased, subscription and implementation information, transaction records, and customer relationship history.
  • Billing information, such as billing contacts, billing addresses, and payment-related information. Payment card information may be processed directly by our payment service providers rather than stored by LaborAI.
  • Customer content and operational data submitted through the Services, which may include warehouse, workforce, scheduling, productivity, shipment, inventory, item, order, equipment, and related operational information. Customers are responsible for ensuring that they have the authority to provide this information to LaborAI.
  • Job applicant information, such as a résumé, employment history, education, and other information submitted in connection with an application.

Information collected automatically

When you visit our website or use the Services, we and our service providers may automatically collect:

  • IP address and approximate location derived from it;
  • browser, device, operating-system, and network information;
  • pages viewed, links clicked, referring pages, dates, timestamps, session information, and interactions with our website or emails;
  • cookie identifiers and other online identifiers; and
  • diagnostic, performance, log, and security information.

2. Cookies, Analytics, and Buyer-Intent Information

  • understand website engagement and potential business interest, including by identifying organizations that may be interested in LaborAI;
  • conduct analytics, research, product development, and service improvement;
  • send service messages and, where permitted, marketing communications;
  • detect, investigate, and prevent fraud, misuse, security incidents, and unlawful activity;
  • enforce our agreements and protect our rights, users, customers, personnel, and others;

We may aggregate or de-identify information so that it cannot reasonably be associated with an individual. We do not attempt to re-identify information that we maintain as de-identified unless permitted by law.

  • service providers and subprocessors that support hosting, cloud infrastructure, analytics, CRM, communications, customer support, security, payments, implementation, and other business operations;

  • integration partners at the customer's direction or as necessary to connect LaborAI with warehouse management, enterprise resource planning, labor management, and other customer systems;

  • government bodies, regulators, courts, or other parties when required or permitted by law or reasonably necessary to protect rights, safety, and security; and
  • transaction participants in connection with an actual or proposed financing, merger, acquisition, reorganization, sale of assets, insolvency, or similar corporate transaction.

We may also disclose information with your direction or consent.

LaborAI does not sell personal information for money. Some privacy laws define "sale," "sharing," or "targeted advertising" broadly enough to include certain analytics or advertising technologies. Where those laws apply, we provide the notices and opt-out mechanisms they require.

5. International Processing and Data Transfers

LaborAI is based in the United States and uses service providers that may process information in the United States, Canada, and other jurisdictions. As a result, personal information may be transferred to or accessed from a country different from the country where it was collected. It may be subject to the laws of those jurisdictions and may be accessible to courts, law-enforcement agencies, or other authorities in accordance with applicable law.

Where required, LaborAI uses appropriate contractual or other safeguards for international transfers of personal information.

No system or transmission method is completely secure, and we cannot guarantee absolute security. Customers and users are responsible for protecting their credentials, appropriately configuring permissions, and notifying us promptly of suspected unauthorized access.

We retain personal information for as long as reasonably necessary to provide the Services, maintain our relationship with you, fulfill the purposes described in this Privacy Policy, comply with legal and contractual obligations, resolve disputes, enforce agreements, and protect our legitimate business interests.

If your information was provided to LaborAI by your employer or another LaborAI customer, please direct your request to that organization first. We will assist the customer as required by law and our agreement with it.

Marketing communications

You may unsubscribe from marketing emails using the unsubscribe link in the message or by contacting us. You may still receive non-promotional communications concerning your account, transactions, security, or use of the Services.

Browser privacy signals

Where required by applicable law, we recognize legally valid opt-out preference signals, such as Global Privacy Control, for the browser or device sending the signal.

9. Additional Information for Canadian Residents

If Canadian privacy law applies, LaborAI processes personal information in accordance with applicable federal and provincial privacy requirements. You may request access to or correction of personal information and may withdraw consent, subject to legal and contractual restrictions and reasonable notice.

You may submit a question or complaint to LaborAI's Privacy Officer using the information in Section 14. If you are not satisfied with our response, you may have the right to contact the Office of the Privacy Commissioner of Canada or the applicable provincial privacy regulator.

10. Additional Information for Residents of Certain U.S. States

Residents of California and certain other U.S. states may have additional privacy rights where the relevant state privacy law applies to LaborAI. These may include rights to know, access, correct, delete, and obtain a portable copy of personal information, and to opt out of certain sales, sharing, targeted advertising, or profiling.

For purposes of applicable state privacy laws, the categories of personal information we may collect are described in Section 1; the sources include you, your employer, LaborAI customers, your device and browser, integrations, service providers, business partners, and publicly available sources; the purposes are described in Section 3; and the recipients are described in Section 4.

To submit a request or opt out where applicable, contact us using the information in Section 14 or use the available cookie-preference controls. LaborAI does not knowingly sell or share the personal information of individuals under 16 for targeted advertising.

11. Third-Party Websites and Services

Our website and Services may link to or integrate with third-party websites, applications, platforms, or services. LaborAI does not control and is not responsible for the privacy practices of those third parties. Their handling of information is governed by their own terms and privacy notices.
